Changes in patent law

From July 7, 2018, amendments to the Law of the Republic of Belarus of December 16, 2002 “On Patents for Inventions, Utility Models, Industrial Designs”, introduced by the Law of December 18, 2017 No. 88-З, come into effect. The changes concern the terms of protection, the definition of the patented objects, the right to obtain a patent, office facilities, compulsory licensing, pre-use and post-use regimes, the use of patented objects, the protection of the patent owner’s rights from violations, procedural moments, and numerous editorial corrections. Changes have touched on most of the provisions of the Law, which allows them to be considered as the most ambitious adjustment of patent law.

The most significant changes are as follows:

– the term of protection of utility models has been increased for 2 years (the total term of protection became up to 10 years);

– methods of medical assistance are excluded from objects of legal protection;

– a new way of protecting the rights of the patent owner from violations is introduced – compensation in the amount of 1 – 50 000 basic values.
