September 27, 2006Vilnius District Court dismissed a claim of Mars Inc. on invalidation of defendants' Ulker Gida Sanayi ve TicaretAS and "Angolita" Ltd. trademark METRO registration No. 36856 and prohibition of use of the said trademark. The Court decided that trademark METRO is not similar to the plaintiff's trademarks MARS (Reg. No. 6792, 20941 and 26604). The Court as well dismissed the counterclaim of defendant Ulker Gida Sanayi ve Ticaret AS on cancellation of registration of trademarks MARS on the ground of non-use basing its decision on the fact that although trademarks were not used by the owner of the trademarks, however they were used with his consent and therefore, the fact that the license was not registered can not be used as a ground for cancellation of trademark registration on the ground of non-use.
