On June 16, 2009, The Appeals division of Lithuanian State Patent Bureau satisfied opposition No. 2271 of the interested person AFOI HATZIPRODROMOU AE-ANONYMI EMPOROVIOMICHANIKI ETARIA IPODYMATON regarding cancellation of the international trademark „COLLECTION ADAM“ registration No. 964375 owned by "ADAM" KRAWIECTWO LEKKIE, BIELIŹNIARSTWO Adam Korezak, Monika Korezak spólka Jawna.
The Appeals division stated that main element in the trademark “adam’s shoes” of the interested person is the word “adam’s”, because the second word “shoes” directly prescribes goods, for which the trademark is registered. Besides, the second element “shoes” visually is too small and can be unnoted by the consumer. The opposed trademark is verbal, compounded of two words COLLECTION ADAM, filled with standard capital letters. The main element in this trademark is word “ADAM”, because the first word “COLLECTION” is related with proper word “ADAM” and underlines it. It was stated that the opposed trademark „COLLECTION ADAM“ is phonetically, visually and semantically confusingly similar to the trademark of the interested person, because of the coincident predominant word “adam” in both trademarks. |
