October 1, 2008 The Section of Appeals of Lithuanian State Patent Bureau has satisfied an opposition No. 2144 of ALPS ELECTRIC CO., against the validation of the International trademark “alp” registration No. 936527 owned by PETRIS ENGINEERING & TECHNOLOGY CO. The Section of Appeals stated that word element “alp” of the opposed trademark is fully inserted in trademark “ALPS” of the interested person. Moreover the coincident element stands in the beginning of the interested person’s trademark. The aforesaid determines phonetical and visual similarity of the marks. Through semantics of both words differs, however it is presumptive that most part of the Lithuanian consumers’ will treat these words as made-up or as a combination of several letters, therefore the similarity of the marks would be even strengthened. To sum up, The Section of Appeals claimed trademark “alp” being misleadingly similar to the trademark “ALPS” owned by the interested person. |
