On December 15, 2008 The Section of Appeals of Lithuanian State Patent Bureau has satisfied an opposition No. 2166 of the interested person Arysta LifeScience Corporation against the validation of the International trademark “LARISTA” registration No. 946403 owned by BAYER AKTIENGESELLSCHAFT. The trademark of the interested person is composite uncoloured mark, compounded of verbal elements “Arysta LifeScience” (filled with Latin alphabet in simple type) and graphic element. And the only element of the opposed trademark is word “LARISTA”. The Section of Appeals stated that comparing mentioned trademarks visually, phonetically and semantically will be compared basic verbal elements – “Arysta” and “LARISTA”. Due to visual and phonetic similarity of marks (semantically marks are not compared because they are artificially compounded), the opposition was satisfied and registration of the international trademark “LARISTA” was not validated in Lithuania.
