August 5, 2008 The Section of Appeals of Lithuanian State Patent Bureau rejected opposition No. 2163 of FIDIA FARMACEUTICI SPA, who is the owner of trademark “BIONECT” (reg. no. 39944). The opposition was regarding trademark “BIONECTAR” (reg. No. 56019) of „Medicinos tyrimų centras“. The Section of Appeals stated that he opposed trademark was not confusingly similar to the trademark of the opposing party because it is made of larger number of letters and phonetic difference also exists. Moreover, the exact goods for which trademarks “BIONECT” and “BIONECTAR” are registered differs in their composition and look, therefore the consumers would not be misled.
