On October 21, 2008, the Section of Appeals of the State Patent Bureau of the Republic of Lithuania accepted the opposition No. 2191 of the interested person UAB „CENTRUM“, regarding trademark „HOTEL VIEŠBUTIS CENTRAL 1902“ of UAB „Naujasis Vilnius“.
The interested person founded on previous trademarks „CENTRUM C“ and „CENTRUM“. The Section of Appeals stated, that words „CENTRUM“ and „CENTRAL“, as main elements of compared marks, are visually similar, since only last letters of abovementioned words are different.
Due to the majority of identical characters in main parts of marks, these elements are also similar phoneticaly. Taking everything into account, the Section of Appeals concluded, that the opposed mark „HOTEL VIEŠBUTS CENTRAL 1902“ is misleadingly similar to the previous trademark of the interested person.
