On March 05, 2009, The Section of Appeals of Lithuanian State Patent Bureau has satisfied oppositions No. 2258 and No. 2259 of the interested person CITYCON OYJ against the validation of the National trademarks “CITYCO” and “CC CITYCO” registrations owned by UAB “CITYCO”.

The trademark of the interested person is compounded of only one verbal element CITYCON filled with standard capital letters and the opposed trademark “CITYCO” is also a verbal mark and filled with standard letters. The opposed trademark “CC CITYCO” is combinative mark compounded of verbal element “cityco” and graphic element in brown and orange colors which is similar to the two letters “C”. The Section of Appeals had stated that the main verbal elements of comparable marks - CITYCON and CITYCO - are notably similar visually and phonetically and therefore the oppositions were satisfied.
