On October 30, 2009, The Section of Appeals of Lithuanian State Patent Bureau partly answered the opposition No. 2297 of the interested person SEARS BRANDS, LLC against the validation of the International trademark “Kraftman” registration No. 968558.

The Section of Appeals stated that compared trademarks “CRAFTSMAN” and “Kraftman” are visually, phonetically and semantically similar. However it was identified that goods in classes 2, 6, 11 and part of the goods in class 9 covered by registration of the opposed trademark are not similar to the goods in classes 7, 8 and 9 registered by the interested person. Therefore the opposition was partly satisfied and International registration of the trademark “Kraftman” was invalidated only in class 7.
