On March 18, 2010, the Appeals division of the Lithuanian State Patent Bureau has dismissed opposition No. 2446 of the interested person Saturn Petfood GmbH regarding cancellation of the trademark “DAGA” No. 59726 owned by UAB “Daljana” for the goods in classes 29 and 31.

The Appeals division stated that general impression of comparable trademarks is not similar due to different elements of both trademarks. Opposed trademark is compounded of various elements (verbal, graphic and chromatic) while trademark of the interested person is compounded of only one verbal element “Daya”. Moreover the wordy parts of the comparable trademarks are not similar under any criteria of similarity too. Therefore it was stated that the opposed trademark “DAGA” is not confusingly similar to the earlier trademark “Daya” of the interested person.
