On March 16, 2009, The Section of Appeals of Lithuanian State Patent Bureau partly answered the opposition No. 2218 of the interested person OMS Investments, Inc. against the validation of the International trademark “easygreen” registration in regard to some services in class 44.

The Section of Appeals stated that trademark of the interested person is compounded of the verbal combination EASY GREEN, which is filled with capital letters. The opposed trademark owned by "GARTEN KURZEME", SIA. is compounded of a verbal element “easygreen” filled with small letters in two colours – brown and green and also the opposed trademark has graphic element. The Section of Appeals stated that comparable marks are similar because the main verbal elements - EASY GREEN and easygreen - form common visual impression and there exists a likelihood of confusion on the part of the public in regard to the services in class 44.
