On July 30, 2009, the Appeals division of the Lithuanian State Patent Bureau has dismissed opposition No. 2192 of the interested person PHILIP MORRIS PRODUITS SA regarding cancellation of the trademark “Slims e a”, fig. registration No. 56297 owned by AKCIONERNO DRUŽESTVO “BULGARTABAK-HOLDING”.

The Appeals division stated that the opposed trademark contains much more independent and individualizing elements which indeed form general impression for the customers. And according to this general impression compared trademarks are not visually similar. Also trademarks differ phonetically and semantically. Therefore it was stated that the opposed trademark “Slims e a”, fig. is not confusingly similar to the earlier trademark “EVE” of the interested person.
