On March 25, 2010, the Appeals Division of Lithuanian State Patent Bureau has satisfied opposition No. 2121 of the interested person EXPERT INTERNATIONAL GMBH regarding the refusal of protection of the National trademark “b expert” Reg. No. 60239 owned by UAB “BMS GRUPĖ”.

The Appeals Division has stated that the main and dominant elements of the comparable combined trademarks “expert” and “b expert” are words “expert”, because these elements are clearly visible and legible. Repeat of the word “expert” in both comparable trademarks creates visual similarity which is enhanced by the similarity between graphical elements. Phonetically and semantically marks identical. Considering all the stated circumstances, there was remarked that the opposed trademark “b expert” is confusingly similar to the earlier Community trademark “expert” of the interested person.
