On January 21, 2008, The Section of Appeals of Lithuanian State Patent Bureau has satisfied an opposition No. 2239 of the interested person SVUS Pharma a.s. against the validation of the National trademark “FORMOX” registration No. 56779 owned by UAB "ORIVAS".
International trademark “Farmax” owned by the interested person is written in Latin letters and the first letter of the word is capital and rest letters are small. The opposed trademark also is a word mark, which is compounded of only one element “FORMOX” in standard capital letters. The Section of Appeals stated that trademarks are similar due to common visual impression. Both words are the same length and compounded from the same number of letters and syllables. Marks are visually and phonetic similar due to coincident letters and syllables which are set in the same sequence. Consequently the opposition was satisfied and the registration of the trademark “FORMOX” was recognised as invalid. |
