On March 05, 2009, The Section of Appeals of Lithuanian State Patent Bureau has satisfied oppositions No. 2084 and No. 2085 of the interested persons W.L.GORE & ASSOCIATES Inc and W.L.GORE & ASSOCIATES GmbH against the validation of the International trademark “GORTEKS” registration owned by Marcin Koczotowski.

The both earlier trademarks "GORE-TEX“ are verbal. The opposed trademark "GORTEKS“ is compounded of an ornament filled above the mark and horizontal line after it and also there is a verbal element filled with standard capital letters under the mark. After the estimation of the verbal elements in comparable trademarks the Section of Appeals stated that they are similar visually and phonetically. Therefore oppositions were satisfied and International registration of the trademark “GORTEKS” was invalidated.
