On February 24, 2009 The Section of Appeals of Lithuanian State Patent Bureau has satisfied the opposition No. 2207 of the interested person GUCCIO GUCCI SPA against the validation of the International trademark “GUECCA” registration No. 951788 owned by MEHMET GEDIKLI.
The Section of Appeals stated that the opposed trademark “GUECCA” is misleadingly similar to the earlier trademarks “GUCCI” of the interested person and also is presented to register for the denotation of identical and similar goods in class 25. Therefore there exists a likelihood of confusion on the part of the public. In addition the confusion is even increased due to the strong distinctive sign of the trademarks of the interested person and they are widely used in nationally and internationally as well.
