On October 27, 2008, the Section of Appeals of the State Patent Bureau has dismissed the opposition No. 2113 of the interested person Hokochemie GmbH against the validation of trademark „OKKO PRODUCTS“ (Reg. No.55373) owned by UAB „Senukų prekybos centras“.
It was stated, that comparable marks were not visually similar, since main elements of marks HOKO and OKKO were different enough. Particularly, beginnings and graphic representations of aforesaid marks are dissimilar. What is more, comparable marks HOKO and OKKO PRODUCTS are not phonetically similar, due to their different beginnings and the fact, that the protested mark is compounded of two verbal elements that brings a different consonance. Semantically aforesaid marks are not assimilated, for verbal elements HOKO and OKKO are artificially compounded. |
