On May 7, 2009 The Appeals division of Lithuanian State Patent Bureau satisfied opposition No. 2288 of the interested person UAB „MG Valda“ regarding cancelation of the trademark „ valda.lt“ registration owned by UAB „Mano biuras“.

The Appeals division stated that trademark of the interested person is combinative mark compounded of various elements: verbal combination “MG VALDA” where the word “VALDA” is framed into horizontal lines, this trademark is filled with blue and dark green colours. The main element of this trademark which forms common visual impression is verbal element “MG VALDA”. The opposed trademark also is combinative. This trademark is compounded of the superscription “valda.lt” and above this word there is a graphic element which reminds letter “M” or shapes of stylized roofs of the houses. Under the word “valda.lt” there is horizontal line under which it is written in smaller letters “real estate” and this superscription is recognized as descriptive for the services in class 36. The main elements of this trademark are word “valda” and graphic element. Consequently trademarks are similar visually, phonetic and conceptually, therefore the conclusion is that the opposed trademark „valda.lt nekilnojamasis turtas“is confusingly similar to the trademark „MG VALDA“of the interested person.
