On October 21, 2008, The Section of Appeals of the State Patent Bureau of the Republic of Lithuania dismissed the opposition No. 2057 of the interested person UAB „LIETUVOS RYTAS“ regarding the acclaim of registration (No.54660) of trademark „MOTERIS“ of UAB „EKSPRESS LEIDYBA“ as invalid.
The interested person affirmed that the opposed trademark directly indicates the purpose of goods in class 16, namely: woman, whereof and for whom publications are intended. However, the Section of Appeals stated, that the direct purpose of goods („Printed matter, periodicals, magazines, books, newspapers“) in class 16 is to supply information. One of the groups of consumers of these goods can be women. Yet, the range of readers of the aforesaid periodical is wider and can consist of other groups. Further, the word “woman” could introduce reader with the content of the publication, though the word itself does not indicate the purpose of goods directly and specifically, it can only provide assumption. In conclusion, the opposition was dismissed and the registration of trademark „MOTERIS“ is continued to be valid.
