On November 27, 2008, The Section of Appeals of the State Patent Bureau partly answered oppositions No. 2211 and No. 2212 of the interested person MEDIA PLANNING GROUP, S.A. regarding the registrations of the trademarks „MP“ owned by UAB „MEDICINOS PROJEKTAI“.
The Section of Appeals has remarked the combination of the letters “MPG” and “MP” as the main elements of the marks. It was stated that impression of the trademarks is similar due to the same structure of the trademarks, because they are compounded of the letters combinations. First letters are coincident and the sequence is identical as well. The main element of the opposed trademarks is fully repeated in the trademarks of the interested person. Compared trademarks also have similar fulfilment of the letters. All these circumstances determine visual similarity of the marks, and visual similarity determines phonetic similarity, therefore the registration of trademarks “MP” was recognized as invalid for the services in class 35.
