On April 30, 2009 The Appeals division of Lithuanian State Patent Bureau satisfied opposition No. 2092 of the interested person ORI INDUSTRIA S.P.A. regarding cancelation of the trademark „Ovi!“ registration owned by Obshestvo s ogranichennoi otvetstvennost‘ju „20-y KORPUS“.
The Appeals division stated that trademark of the interested person is compounded of the word “ORI” which is filled with capital letters similar to standard characters. The opposed trademark is compounded of the stylized word „Ovi!“. Predominant elements words „ORI“ and „Ovi“ has common visual impression, because of the same length and number of letters, letters are coincident except central characters. Trademarks will be pronounced similarly, because both trademarks are compounded of one syllable and differs in one sound, which is in the middle of the words between identical vowels “O” and “I”. Conceptually words are not comparable, because consumers in Lithuania these words will understand as artificial, without meaning. Comparable trademarks “ORI” and “Ovi” are similar visually and phonetic therefore it was stated that the opposed trademark is confusingly similar to the trademark of the interested person. |
