On August 8, 2009, The Appeals division of Lithuanian State Patent Bureau has satisfied opposition No. 2307 of the interested person Hexal AG regarding the refusal of protection of the International trademark “SIMCOR” (Reg. No. 970966) owned by Antibiotice S.A.

The compared trademarks differ in two additional letters “va” which are in the middle of the interested person's trademark. However the Appeals division considered the coinciding six letters and therefore stated visual and phonetic similarity of the compared trademarks. The opposition was satisfied and International registration of the trademark “SIMCOR” was invalidated.
