On May 20, 2010, The Appeals Division of Lithuanian State Patent Bureau has satisfied opposition No. 1973 of the interested person VKR HOLDING A/S regarding the refusal of protection of the National trademark “LEVELUX” Reg. No.54479 owned by UAB „Šiaulių Tauro televizoriai“.
The Appeals Division has stated that the main elements VELUX and LEVELUX of the comparable trademarks are similar under general perception because mark of the interested person is fully repeated in the opposed trademark. The visual similarity is enhanced by the similar writing: standard type and capital Latin letters. The repeating element VELUX results phonetically similarity as well. Semantic comparison is not possible as both comparable trademarks are compounded of artificial words. |
