On December 17, 2009, The Section of Appeals of Lithuanian State Patent Bureau partly answered the opposition No. 2120 of the interested person Bennett Footwear Group, LLC against the validation of the trademark “SPIGA BOUTIQUE” No. 55465.

The Section of Appeals stated that compared trademarks “VIA SPIGA” and “SPIGA BUTIQUE” are similar form general visual impression because of the repeated verbal element SPIGA. Furthermore main verbal elements of compared trademarks are represented in a similar way and there are no exclusive graphical elements. Also it was stated that the registration of opposed trademark covers partly similar services in class 35 and pursuant to this fact it was stated that there exists a likelihood of confusion and opposed trademark registration was invalidated for the part of the services in class 35.
