On March 25, 2010, the Appeals division of the Lithuanian State Patent Bureau has dismissed opposition No. 2422 of the interested person BONGRAIN SA regarding cancellation of the trademark “iki ekspress” No. 59207 owned by UAB “PALINK”.
The Appeals division has stated that general impression of comparable trademarks “X-PRESS” and “iki express” is not similar due to different structure of both trademarks and lack of coinciding elements. When comparing phonetics, it was remarked that the trademarks have some pronunciation similarities. However element “iki” in the beginning of the opposed mark highlights differences of the sound of the marks. Moreover due to the different meaning of notional parts of the trademarks, the overall semantic content differs as well. Therefore it was stated that the opposed trademark is not confusingly similar to the earlier trademark of the interested person. |
