The expected changes of the intellectual property laws in Belarus in 2018
From January 1, 2018, the entry into force of the Customs Code of the EAEC is planned. The long-awaited code finally was adopted by all the countries of the EAEC. With its entry into force, the launch of the work of the Customs Register of Intellectual Property Objects of the EAEC is connected.
Amendments to the Law of the Republic of Belarus “On Patents for Inventions, Utility Models, Industrial Designs” were adopted in the second reading in the Parliament. The law does not provide for significant changes in the protection of inventions, utility models, industrial designs. Its main task is the further harmonization of the legislation of the EEA countries, as well as the implementation of the provisions of the Patent Law Treaty. The draft law also provides for improving the procedure for patenting by replacing a number of obsolete norms and gaps on the basis of the accumulated national experience. Among the changes proposed in the draft law are the definition of the invention, the change in the validity period of the patent for the utility model, and the definition of the content of the exclusive right to the patented objects. The draft law pending the further consideration by the Council of the Republic.
The situation with amendments to the Law of the Republic of Belarus “On Copyright and Related Rights” remains unclear. The draft law was initiated by the Council of the Republic, which is unusual for the legislative activities of Belarus, but has not yet been formally introduced. It is expected that in the near future it will be finalized and sent to the House of Representatives. The main issues discussed during the drafting of the bill are the problem of payment of author’s remuneration by cable operators through collective management organization and a proposal to reduce the minimum amount of compensation for copyright infringement.
